We provide airport, SGR, hotel, city-to-city, and long-distance ground transfer services across Kenya. Access to this website, mobile communication channels, and any service we offer is strictly conditional upon your acceptance of all terms, conditions, notices, and policies contained herein.
Please read these Terms of Service carefully before accessing or using our website or booking any transfer. By accessing or using any part of our platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service. If you do not agree to all terms and conditions in this agreement, you may not access the website or use any of our services. Where these Terms of Service constitute an offer, acceptance is strictly limited to these terms.
1. Definitions
For purposes of these Terms:
• “Client” or “Passenger” refers to any person booking or using our services.
• “Transfer” means transportation arranged from one location to another using our vehicles or
vehicles operated by our partners.
• “Booking Platform” refers to our website, WhatsApp, phone line, or any digital system used to
secure transfers.
• “Driver” refers to any contracted or employed chauffeur delivering transfer services.
2. Service Scope
Innocent Ultimate Transfers provides:
• SGR Miritini/Terminals transfers (to & from Malindi, Watamu, Kilifi, Diani, Ukunda & Mombasa).
• Airport transfers (Moi Airport, Malindi Airport, Ukunda Airstrip, JKIA connecting services).
• Hotel, residential, and corporate transfers.
• Private hire, chauffeur and road-trip services.
• Group transport for tours and events.
All services are subject to availability, professional standards, and safety regulations applicable
under Kenyan transport laws.
3. Booking Confirmation & Payments
• All bookings must be confirmed through our website, WhatsApp, or official phone numbers. • Bookings are confirmed only after full or partial payment as indicated during booking. • Payments can be made via M-Pesa Business Till Number 9267079 or any additional verified channels provided by our support team. • Clients must share accurate pickup times, locations, contact numbers, and number of passengers. • SGR train booking assistance is free only if you are using our transfer services. • SGR train bookings made without using our transfers attract a non-refundable service fee of KSh 100 per ticket. • We reserve the right to reject, cancel, or modify a booking should information provided be incomplete, misleading, or unsafe.
4. Pricing & Charges
• Prices listed on our website or communicated by our team are subject to change without prior notice based on demand, fuel costs, or route changes. • The fare from SGR Miritini to Kilifi Office is KSh 800, to Malindi Office KSh 1,000, and to Watamu Office KSh 1,000 — and the same fares apply for return trips to SGR. • Children aged above 4 years must pay for a full seat as required by Kenyan transport regulations. • Extra charges may apply for: – additional stops, – waiting time, – night-time transfers (9:00 PM – 5:00 AM), – oversized luggage, – special requests.
5. Cancellations, Refunds & No-Shows
• Cancellations made 12 hours before pickup qualify for a full refund or free rescheduling. • Cancellations made within 12 hours may attract a 50% charge. • Cancellations made within 2 hours, or failure to show up at the pickup point, are fully chargeable. • Refunds are processed within 24–48 hours. • If a client requests rescheduling, it is subject to availability and may involve additional charges.
6. Passenger Responsibilities
By using our services, clients agree to:
• Provide accurate pickup details and be available at the agreed pickup time.
• Ensure minors are accompanied by a responsible adult, unless prior arrangements have been approved.
• Declare luggage accurately to avoid disputes or capacity issues.
• Avoid carrying illegal items, weapons, hazardous materials, or prohibited goods under Kenyan law.
• No use of alcohol, drugs, or intoxicating substances is allowed on board any of our vehicles.
• Respect the driver, the vehicle, and other road users.
• Wear seatbelts at all times as required by Kenyan traffic regulations.
Any breach may lead to termination of service without refund.
7. Vehicle Allocation & Substitution
• Vehicles are assigned based on availability, passenger count, luggage size, and route. • We may substitute a vehicle with an equal or higher class option where necessary. • Innocent Ultimate Transfers may use trusted partner vehicles where required to meet customer demand.
8. Delays, Traffic & Force Majeure
While we strive for punctuality, we are not liable for delays caused by:
• Traffic congestion,
• Weather conditions,
• Security checks,
• Roadblocks,
• Vehicle breakdowns,
• Natural events,
• Or any situation beyond our reasonable control.
Alternative arrangements may be made but cannot be guaranteed.
9. Luggage Policy
• Clients must declare luggage quantity and size during booking. • Oversized, fragile, or high-value items must be disclosed in advance. • Drivers may refuse luggage that poses a safety risk or exceeds vehicle capacity. • Innocent Ultimate Transfers is not liable for damage caused by improper packing.
10. Safety & Conduct
• Harassment, threats, or abusive behavior will not be tolerated. • Drivers may terminate the service if they feel unsafe or disrespected. • Smoking inside the vehicle is prohibited. • Alcohol consumption on board is strictly forbidden.
11. Liability & Insurance
• Innocent Ultimate Transfers complies with Kenyan transport laws and maintains valid passenger insurance. • We are not responsible for indirect losses such as missed flights, SGR departures, business delays, or personal inconvenience. • Liability is limited to the amount paid for the specific transfer.
12. Data Protection & Privacy
• We collect personal information solely for service delivery and safety. • We do not share or sell client data except to trusted partners involved in completing your transfer. • All data handling follows the Kenyan Data Protection Act, 2019.
13. Amendments to Terms
We may update or modify these Terms of Service at any time. Continued use of our services constitutes acceptance of the updated terms.
14. Governing Law
These Terms of Service are governed by the laws of the Republic of Kenya. Any disputes shall be resolved through negotiation, mediation, or Kenyan courts where necessary.
